@yumna speaks with Hassan Ben Imran, a member of the Governing Council of Law for Palestine, about Palestinians' long effort to access international legal institutions and the impact of this development.
#icc vs #icj
"The ICC considers cases against individuals and as such has to be distinguished from the International Court of Justice, which rules on disputes between states, such as the case brought by South Africa against Israel in January 2024 under the 1948 Genocide Convention."
Outlook is pro-Israel (no surprise), but has many quotes of reactions from [#Israeli politicians and experts about the ICC prosecutor's request for arrest warrants.]
The #ICC can issue for signatories countries an arrest warrant on #Netanyahu because it has jurisdiction over international crimes committed in @Palestine since 2012
BUT
If @Israel doesn't recognise the #ICC, its territory isn't included in the jurisdiction, and the crimes of Hamas where carried out there, then how can the #ICC issue a legally binding arrest warrant on Hamas' leader?
[cont’d] Let Justice in the Gaza War Take Its Course (David Kaye)
Kaye says that the #ICC has jurisdiction over international crimes committed in Palestine since 2012, when the court's territorial jurisdiction was expanded to include the territory occupied by Israel.
[…] Regardless of the outcome of the cases, the prosecutor’s request that the court issue arrest warrants for #Netanyahu and #Sinwar helps cut through the polarizing language of the moment and promotes the idea that the basic rules of international humanitarian law apply to all. Anyone demanding an end to the conflict in Gaza and the release of all hostages from the grasp of Hamas should embrace the decision.
[…] There is a global cost to opposing the International Criminal Court. With U.S. and European support, the court is seeking to prosecute President Vladimir #Putin for alleged crimes in Ukraine. The court promotes the global interest in accountability for the worst crimes under international law. Attacks on it only benefit those who, like Mr. Putin, seek to delegitimize its existence.
