Providing a substantially inferior outcome to someone with an ADA need absolutely violates ADA rules.

When stuff like this has gone to court it hasn't been pretty for the offending organization.

There's a bigger question about how much of what Spotify currently provides falls under ADA. Web services used to get a free pass. They largely don't anymore.

Source: some of this stuff is my problem, professionally. And no, I'm not going to look up a primary source for anyone. That's Spotify's lawyers job.

The fact possibility that they're unable to provide lyrics gives radio stations a free pass on this, under ADA (and most similar laws).

Edit: Correction, per correction below - options for providing radio captions do exist.

it's their prerogative to try and get people to pay for the service.

Except that this attempt could easily be shown to largely land on folks with accessibility needs. That's a big no-no under many laws.

An interesting comparison is pay-to-ride elevators. For most folks an elevator is a nice convenience they would not mind occasionally paying for.

But for some folks, the elevator is completely essential. This dynamic resulted in making pay-to-ride elevators illegal in most places, today.

It's probably not an issue for a station that simply doesn't have that level of captioning, yet.

But I take your point - it would likely be a violation if they had that captioning and tried to monetize it. (In my substantially professionally trained but still non-expert opinion.)

Once an organization can no longer claim an accessibility accomodation is an undue burden, then various laws kick in dictating how that accessibility accomodation must be managed.

As was pointed out, many radio stations do provide captions, and in doing so, fall under the same laws about how they managed those captions.

Spotify is also a big enough organization that any claim of "undo burden" would probably not hold up in court, anyway.

While a small local radio station might well be protected, and is a good example of why such exceptions exist.

A court case about it could be a way for Spotify to pass the problem to their licensors, in theory.

Defining "full equal service" in a way that carves out big portions (like knowing what the lyrics are) in ways that fully able bodied people take for granted - has gone badly for companies that let it go to court.

  • Netflix advertisements.
  • Zoom mandates staff return to offices.
  • Microsoft forgets what the "P" in "PC" stands for.
  • Toys R Us implements a shitty holiday gift returns policy.
  • Sears decides to sacrifice reputation for quarterly stock price gains.
  • Walgreens decides bottom-of-the-barrel incompetent pharmacists can uphold their "get it all done in one visit" secret sauce.

They can't grow that way but they could easily hold on and remain profitable, popular and successful.

They were well on their way to enjoying "Kleenex" or "Oreo" stable market success, but their leadership and shareholders apparently aren't satisfied with winning.

The stupidly easy solution is to just give them stuff that has already been successfully delivered to production to market, 9 months from now. There's invariably a huge backlog of years worth of successes that marketing wasn't even aware of.

I’ve not worked with a marketing team where that would work, but maybe it will for some.

I've never been anywhere that I thought it would work, but it ultimately did, almost everywhere.

I've found it takes a few iterations, but the marketing folks in on it love being the ones who actually can reliably deliver on their promises.

It doesn't work for the marketers that promise whatever they please without talking to dev, but I don't find them to be worthwhile professional allies, so I don't sweat it.

Very true. It doesn't help with that case, and that one does happen. I've had the best luck saying "we don't do that, but we're scrambling to add it" in that situation.

I went back to Windows several times before I made the switch permanently to Linux. You just gotta do what works for you.

This is the way.

I went back and forth for years. Tuning and tweaking to find what works for me. Spoiler - the fully open source options are what worked best for me, eventually.

For awhile gaming was the only place I put up with non-Linux anymore. And now with my SteamDeck, I have an easy way to avoid buying games that aren't Linux ready.

A bit of a weird title, but basically what’s a game that’s more than a year old but still considered “modern” that you love? There’s no real strict definition for modern, I’d just like to see some discussion around great games that aren’t quite classics yet (but probably will be one day)....

It's an interesting era when an organization can have a single user, and choose to leave that single user with 85% of the promised functionality no longer functional. But is happily pursuing it's second user.

Yeah. I also can think of lots of reasonable reasons, but if those were the real reasons, the company should still be making commitments and plans with their first user...

The healthy stuff sounds like: "We intend X follow up procedure, but it needs to follow Y precaution."

Hell, even companies that have no intention to help usually take the time to lie and claim that they do.

That's part of what makes me see this as a really bad look.

"Install it deeper" isn't rocket science, and it sounds like their first volunteer is willing.

They just want the extra data from leaving their first volunteer where they landed.

Human subject experiments are supposed to carry more long term obligation than this.
